PREAMBLE

Welcome to &TIMELESS! These terms and conditions (further referred to as "Terms") govern your use of the &TIMELESS website and services, as well as purchases made on this site or any associated platforms such as Spotify. By using this website or placing an order, you agree to these Terms. Our products are unique, made-on-demand, and non-returnable. Please review these Terms carefully. If you do not agree to any of the provisions, please refrain from using our services.

1. DEFINITIONS OF TERMS

1.1. In this T&Cs the following terms shall be defined and interpreted as follows:

Seller = TIMELESS STUDIO S.R.L, with its registered office at 3 Iulia Street, 317405 Vladimirescu, Arad County, Romania, registered with the Trade Register under number J2/1552/2022, with CUI 46664694;

Buyer/Customer = natural person who places an order on &TIMELESS website;

Contract = the totality of the provisions of this Terms, which the Customer accepts by placing an order on this website. According to Law no. 365/2002 on electronic commerce the contract shall be deemed to be concluded when the acceptance of the offer to contract has become known to the seller;

Terms and Conditions = provisions governing the contractual relations between visitors and users or the website and the seller. Also, these Terms may be modified and updated at any time;

Order = the Customer's intention to purchase products made by &TIMELESS. The order will acquire contractual value only when accepted by seller by issuing a confirmation of processing and delivery;

Products = unique & made on demand products sold & created by TIMELESS STUDIO S.R.L;

Products made-on-demand = Our made-on-demand products are manufactured only after an order has been placed. These items are produced following our standard designs and sizing options (e.g., S, M, L, etc.) and are not made to individual measurements or customized specifications. Because each item is produced specifically to fulfill a confirmed order, made-on-demand products are not eligible for cancellation, return, or exchange, except as required by law;

Personal data = any information relating to a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more specific elements specific to his physical, physiological, genetic, mental, economic, cultural or social identity;

Data processing = means any operation or set of operations performed on personal data or on sets of personal data collected for the purpose of processing the order, whether or not by automatic means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;

Force majeure = external, unforeseeable and unavoidable event. Without being exhaustive, the following are cases of force majeure: wars, social unrest, floods, fires or landslides and any other natural disasters;

2.1. European Union Compliance

We are committed to complying with European consumer protection laws, including but not limited to:

Directive 2011/83/EU of the European Parliament and of the Council of October 25, 2011 on consumer rights, amending Council Directive 93/13/EEC and Directive 1999/44/EC of the European Parliament and of the Council and repealing Council Directive 85/577/EEC and Directive 97/7/EC of the European Parliament and of the Council
Regulation No 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), applicable in all Member States of the European Union since 25.05.2018 (further referred to as "GDPR")

Where applicable, these laws give you certain rights as a consumer when shopping online. However, please note that some rights, such as the 14-day cooling-off period, do not apply to made-on-demand or personalized goods like those offered by &TIMELESS.

2.2. Global Laws

While &TIMELESS is based in Romania, our products are currently available for delivery within Romania and the European Union only. We aim to expand international shipping in the near future. Once available, we will comply with the applicable consumer protection laws in each jurisdiction, while maintaining our no-return policy due to the custom-made nature of our products.

3. Account Registration

To place an order, you may be required to register for an account. You are responsible for providing accurate and complete information. Misuse or falsification of information may result in the suspension or termination of your account.

You are also responsible for keeping your account credentials secure. Any actions performed under your account are your responsibility.

4. Product Information and Availability

4.1. Made-on-demand Policy

All &TIMELESS products are made-on-demand, meaning they are manufactured only after an order is confirmed. Production is carried out according to &TIMELESS’s standard designs and sizing options, not based on individual customer specifications.

4.2. Product Details

We make every effort to ensure that product details, pricing, and availability are accurate at all times. However, errors may occur, and we reserve the right to correct any errors, inaccuracies, or omissions, and to update information or cancel orders if necessary.

5. Pricing and Payment

5.1. Currency and Taxes

Prices displayed are in EUR (€) unless otherwise noted.

For orders within the European Union, VAT is included in the product price. Customers outside the EU are responsible for any applicable duties or taxes upon import.

Shipping costs are included in the listed price.

5.2. Payment Methods

We accept credit and debit cards, Apple Pay, Google Pay, other payment methods available through Mollie. Payment is required at the time of order placement. If payment is not completed, your order may be canceled.

We use the payment processing service provider Mollie B.V. to securely process all online payments.

5.3. Invoice

You will receive an invoice via email once your payment is successfully processed.

6. Shipping and Delivery

6.1. Shipping Costs

Shipping costs are included in the listed product prices. No separate shipping charges apply, and the amount shown at checkout constitutes the full and final purchase price.

6.2. Production Time

Each piece is crafted on demand. Please allow 14–21 days for production and delivery — timing may vary based on the complexity of your order.

6.3. Delivery Time

Estimated delivery times will depend on the shipping method and destination. Delivery times provided are estimates and may be subject to delays outside of our control (e.g., customs, shipping carrier delays).

6.4. Risk of Loss

The risk of loss and title for products passes to you upon delivery. In the event of delivery issues, please contact us within 14 days.

7. Cancellations, Modifications, and Non-Returnable Products

7.1. Non-Returnable Items

Due to the unique and made-on-demand nature of our products, all sales are final, and returns are not permitted unless the product is defective or incorrectly shipped. Please carefully review your order details, including color and size, before making a purchase.

7.2. Cancellation

You may not cancel your order after it has been placed, as production begins immediately for made-on-demand products.

If you notice an error in your order details, contact us within 24 hours, and we will do our best to assist you, though changes cannot be guaranteed.

7.3. Defective or Incorrect Products

If you receive a defective or incorrect product, you must notify us within 14 days of receiving your order. Please provide details and images of the defect or error, and we will arrange for a repair, replacement, or refund at our discretion.

8. Intellectual Property

All intellectual property rights related to the &TIMELESS brand, products, designs, website content, images, and logos are the exclusive property of &TIMELESS or its licensors.

You are prohibited from reproducing, distributing, or using our content without express written consent from &TIMELESS.

9. Data Privacy and GDPR Compliance

9.1. Personal Data

We respect your privacy and are committed to protecting your personal data in accordance with GDPR.

We collect and process personal data solely for the purposes of fulfilling your orders and providing customer service. For details, please review our Privacy Policy section.

9.2. Your Rights

Correction: You can request corrections to any inaccurate data.

10. Limitation of Liability

Our total liability to you for any claims arising from these Terms or the use of our services will not exceed the total amount paid for the product.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the European Union and Romanian law.

This contract is subject to Romanian law. Any disputes arising between TIMELESS STUDIO S.R.L and Customers will be settled amicably by sending a complaint to andtimeless@gmail.com. If after going through this procedure, the parties fail to reach an amicable solution, the dissatisfied party may apply to court.

The territorial jurisdiction in the event of any disputes shall belong to the court in whose district the Seller is based.

12. Changes to the Terms

&TIMELESS reserves the right to update or modify these Terms at any time without prior notice. Any changes will be posted on our website and will become effective upon posting.

15. FINAL PROVISIONS

This document emphasizes with EU law compliance, particularly GDPR and the EU’s Consumer Rights Directive, while ensuring global applicability. It is designed to protect your brand and business while giving clarity to customers on what to expect from a made-on-demand fashion brand like &TIMELESS.

These provisions are supplemented by the Emergency Ordinance 34/2014 on consumer rights in contracts concluded with professionals, as well as for the amendment and completion of certain regulatory acts, Law No. 296/2004 of the Consumer Code, Law No. 365/2002 on e-commerce.
